Criminal Investigation Continues, And A Lawsuit Has Not Been Filed

        A year has passed since former Brookdale President Peter F. Burnham resigned amid allegations that he charged thousands of dollars in unauthorized expenses. To date, Burnham has not been charged with any crimes.
     Last April, Brookdale’s board of trustees made headlines announcing they would file a breach of contract and fraud lawsuit against Burnham in an effort to recover money that was lost, but since that time no lawsuit has been filed.
     “There is no lawsuit; we aren’t being sued,” said Steven Secare, Burnham’s attorney.
     Recently, the board chairman acknowledged that a lawsuit might be “premature.”
      "As of now, no lawsuit has been filed by Brookdale against Dr. Burnham. The Board of Trustees is anxiously awaiting completion of the criminal investigation that is currently being conducted by the Monmouth Prosecutor’s office,” said board of trustees chairman Josh Elkes in an email.
     First Assistant to the Prosecutor Chris Grammicioni acknowledged the investigation but refused further comment.
     “The board expects the findings of that investigation will help them to evaluate whether instituting litigation against Brookdale’s former president would be likely to yield a financial benefit to Brookdale. It is premature to make a decision of this nature while the investigation is in progress and is ongoing," Elkes said.
